1. Acceptance of Terms
By accessing, browsing, or using this website or engaging the services of TECHWERA EXPORT SYSTEMS PRIVATE LIMITED ("TECHWERA", "we", "us", or "our"), you agree to be bound by these Terms and Conditions and all applicable statutory regulations under the laws of India.
2. Scope of Commercial Engagements
All software development, e-commerce builds, marketing campaigns, AI automation implementations, and consulting services provided by TECHWERA are executed pursuant to formal Statements of Work (SOW) or commercial contracts mutually agreed upon and signed by authorized representatives of each party.
3. Intellectual Property Rights
Unless otherwise specified in a custom Master Services Agreement (MSA), upon full payment of project milestone fees, all bespoke code, visual designs, and customized digital assets developed specifically for the client belong to the client. TECHWERA retains rights to its pre-existing proprietary modules, internal libraries, and general methodologies.
4. Limitation of Liability
TECHWERA strives for technical excellence and robust delivery. However, we shall not be held liable for indirect, incidental, consequential, or punitive damages resulting from third-party platform API outages (e.g. Shopify, Meta, Google, WhatsApp, Amazon), host downtime, or client-side modifications made without our authorization.
5. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of India. Any legal dispute or proceeding arising out of or related to these terms shall be subject to the exclusive jurisdiction of the competent courts in Ahmedabad, Gujarat, India.
